Commissioners Present: Jack Fitzsimmons, Chairman, Jeff Cross, Cass Costa, Len Pinaud, Lloyd Allen and John Rogers.

Staff present: Drew McManus, Conservation Agent, and Melissa Brown, Board Secretary

Jack Fitzsimmons called the meeting to order 6:55pm

Post Hearing Agenda:

Administrative Approval (SE 43-2423) 26 Little Neck Lane: The agent described the request by John Graci (contractor) for an administrative review to build a new retaining wall as current retaining solution is failing. Currently the property has two double stake silt fences, and the applicant and agent upon site visit noted a potentially severe erosion problem where the two fences would fail. The proposal is to build the retaining wall under the existing deck and further shore it up by adding 1 ½ “ stone alongside the wall itself. The agent originally had thought that plantings would be sufficient but upon further review noted the need for more stability and that new plan would compliment the existing drainage plans previously approved by the commission.

 Motion made seconded and unanimously carried to approve plans administratively.

2) Administrative Approval (SE 43-2448) 112 Wading Place Rd: The agent described the request by Cape & Islands Engineering for an administrative review to reduce the size of the proposed garage. Currently the plan calls for the garage to meet up with the properties rock wall.

Motion made, seconded and unanimously carried to approve plans administratively.

3) Approve Minutes from 07/26/07

Motion made, seconded and unanimously carried to approve the minutes from 07/26/07.

Hearing Agenda:

7:00 p.m.  John Mitchell, 106 Waterway (Repair 160 linear feet of damaged timber bulkhead) - NOI
        
Michael Borselli (contractor) represented the applicant and described the project. Mr. Borselli described the applicants wish to repair the current bulkhead by attaching a new composite material in place of the damaged timber. The project itself will require very little disturbance to the property, the commission conditioned that any disturbances be replanted. The commission also conditioned that the area devoid of vegetation to the right of the bulkhead be graded and planted.

Motion made, seconded and unanimously carried to Close and Issue.

7:03 p.m. Janet and Barry Krock, 4 Cross Street (Demolish and rebuild a single family residence) - NOI

Applicants requested continuance until 09/06/07 @ 7:03p.m.

7:06 p.m. Jeffrey Cross, 86 Waterway (Move the proposed bulkhead) - AOC

Applicant requested a continuance until 09/06/07 @ 7:06 p.m.

7:09 p.m. Scott Taylor, 139 Popponessett Island Road (Demolish and rebuild a new single family home with associated appurtenances) - NOI

Joel Kubick (contractor) represented the applicant and described the project. The footprint of the home will not be changing but the driveway will be realigned thus creating the need for the septic system to be moved.  Mr. Kubick did not have with him the green cards for abutter notification proof of mailing and was told that the matter be continued. The agent did note that he would like to do a site visit with Mr. Kubick as he had noticed on his own site visit that a 3 ½ ‘ – 4 ‘ space had been cleared between the marsh and timber wall. The clearing also had two irrigation heads installed within it and the agent wanted to make sure and speak with the homeowner to verify that fertilizers were not being used in that area.

7:12 p.m. Earl Burns, 7 Cricket Way (Rebuild dock in the same footprint) - RDA

Mark Burtis (contractor) represented the applicant and described the project. He stated that the applicant wants to replace the existing dock with a new dock with the same specifications. The agent did note that there is an existing Chapter 91 license for the dock.

Motion made, seconded and unanimously carried to Close and Issue.
